Terms of Service

These Terms of Service ("Terms") govern the relationship between you (the "Customer") and Dylan Hoyt CPO, a DBA of Oversight LLC ("we," "us," "Dylan Hoyt CPO"), when you book or purchase pool and aquatic services through dylanhoyt.com, by phone, by email, or in person.

By booking a service, paying a deposit, or accepting a written quote, you agree to these Terms. Read them in full. If you have questions, ask before booking — we're glad to walk through any section.

01Acceptance of Terms

By engaging Dylan Hoyt CPO for any service — by booking online, paying a deposit, signing a quote, or scheduling work — you agree to be bound by these Terms, the Privacy Policy, and the Refund & Cancellation Policy. These three documents together form the complete agreement between you and Dylan Hoyt CPO for the services purchased.

If you don't agree to these Terms, don't book the service. Existing recurring contracts are governed by the Terms in effect on the date the contract was signed; revisions to these Terms apply to renewals and new bookings only.

02Services Offered

Dylan Hoyt CPO offers residential and commercial pool and aquatic services performed by a Certified Pool Operator (CPO) credentialed through the Pool & Hot Tub Alliance (PHTA). Specific services and current pricing are listed on the pricing page; all rates published there control unless superseded by a written, signed quote.

Service categories include: pool openings and closings, weekly and bi-weekly maintenance, green pool recovery, hot tub service and repair, equipment diagnosis and replacement, water chemistry consulting, and seasonal contracts. Commercial and estate services are available under separate contract.

03Quotes & Pricing

Published rates on dylanhoyt.com are accurate as of the date posted. Custom quotes are valid for 30 days from the date issued and are based on information you provide about the property and the work needed.

Final invoices may differ from a quote if the work scope changes on-site. We will not perform out-of-scope work without first contacting you and obtaining authorization (verbal or written). If you can't be reached and the work is essential to safe completion of the booked service, we will pause and reschedule rather than guess.

Chemicals at cost plus 20% Pool chemicals (chlorine, balancers, shock, algaecide, specialty additives) are billed at our wholesale cost plus a 20% handling and transport markup. Receipts are available on request. This rate is fixed and is not negotiable on a per-job basis.

04Deposits & Payment

A 50% deposit is required at the time of booking for all standard services. The remaining balance is due upon completion of the service. Recurring contracts and seasonal packages follow the payment schedule specified in the signed contract.

Payments are processed by Stripe and may be made by credit or debit card via a Stripe-generated payment link or invoice. Cash and check are accepted by prior arrangement. ACH (bank transfer) is available for invoices over $1,000.

Late balances over 14 days past due may accrue a service charge of 1.5% per month (18% APR) and may be referred to collections at our discretion.

05Scheduling & Weather

We schedule services on a first-confirmed, first-served basis once the deposit clears. Confirmed appointments are calendared and you'll receive a written confirmation by email.

Vermont weather will sometimes force a reschedule. If forecasted conditions (lightning, heavy rain, sustained winds over 25 mph, freezing temperatures during opening, or excessive heat warnings during fieldwork) make a service unsafe or technically inadvisable, we will reschedule at no charge and notify you as soon as possible. Weather reschedules don't reset your deposit and don't trigger any cancellation fee — see the Refund & Cancellation Policy.

06Customer Responsibilities

To complete a service efficiently and safely, you agree to:

  • Provide accurate property and equipment information at the time of booking
  • Ensure safe, unobstructed access to the pool, equipment pad, and water source on the day of service
  • Keep pets away from the work area during the service window
  • Notify us in advance of any property hazards, electrical issues, or recent equipment problems
  • Provide functional GFCI-protected outlets at or near the equipment pad where required
  • Be reachable by phone or text during the service window for any out-of-scope authorization

If access is denied, the property is unsafe, or the conditions materially differ from what was disclosed at booking, we may decline the service on-site. Travel and a partial service charge may apply (see Refund Policy).

07Liability & Insurance

Dylan Hoyt CPO carries general liability insurance and works in compliance with PHTA standards and applicable Vermont law. Certificates of insurance are available on request to commercial customers and property managers.

Limit of Liability Our total liability for any claim arising from a service is limited to the amount you paid for that specific service. We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost rental revenue, lost wages, lost use, lost guests, or business interruption — even if we were advised of the possibility of such damages.

We are not liable for pre-existing equipment failures, damage caused by improper customer-side electrical or plumbing, water damage from sources outside our scope of work, vandalism, theft, weather damage, or failure of equipment installed by third parties. We will document and report any pre-existing condition we observe before beginning work.

08Photos & Marketing

We may take photos and short videos of completed work to use in our portfolio, on dylanhoyt.com, and in marketing materials. Photos never include people, faces, license plates, identifying property markers, or your address. If you would prefer we not photograph your property at all, just say so — verbally or in writing — at any time, including after a job is complete. We'll honor the request immediately and remove any prior images on request.

09Recurring Contracts & Termination

Seasonal contracts and recurring service agreements may be terminated by either party with 14 days written notice. Upon termination:

  • Services already performed are billed in full
  • Prepaid services not yet performed are refunded pro-rata, less a 10% administrative fee
  • Pool chemicals delivered to your property remain yours

If termination is for cause (failure to perform, repeated quality issues, or breach by us), the 10% administrative fee is waived and a full pro-rata refund is issued. Disputes are resolved per Section 11.

10Force Majeure

Neither party is liable for failure or delay in performance due to causes beyond reasonable control, including: severe weather, natural disasters, public health emergencies, government orders, utility outages, equipment supply chain failures, or other events that make safe service performance impossible. Affected services will be rescheduled at no charge as soon as conditions allow.

11Disputes & Governing Law

If you have a concern about a service or charge, the first step is always to contact us directly at (802) 585-1507 or dylan@dylanhoyt.com. Most disputes are resolved within one phone call.

If a dispute can't be resolved by direct discussion, the parties agree to attempt mediation through a Vermont-based mediator before initiating litigation or arbitration. If mediation fails, disputes will be resolved by binding arbitration administered in Vermont under the rules of the American Arbitration Association — except that either party may bring an individual claim in Vermont small-claims court for matters within the court's jurisdiction.

These Terms are governed by the laws of the State of Vermont, without regard to conflict-of-laws principles.

12Entire Agreement

These Terms, together with the Privacy Policy, the Refund & Cancellation Policy, and any signed quote or service contract, constitute the entire agreement between you and Dylan Hoyt CPO with respect to the services covered. They supersede all prior verbal or written communications, proposals, and agreements on the same subject.

If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right or provision is not a waiver of that right or provision.
